Please read these terms and conditions carefully before booking a guided walking tour. By booking a tour, you agree to be bound by these terms and conditions.

1. Booking and Payment:

   a) To book a tour, you must make a reservation through our website at Cronulla Guided Walks;
   b) Full payment is required at the time of booking to secure your booking.
   c) Payment is accepted via FareHarbor.
   

2.  Cancellations and Refunds:

   a) Cancellations made by participants:

   i. If you wish to cancel your booking, you must do so in writing. If you cancel your booking:
   b. More than 48 hours prior to the tour date, you will receive a full refund.

   Within 48 hours of the tour date, no refund will be provided.

   b) Cancellations made by us:

   i. We reserve the right to cancel a tour due to unforeseen circumstances such as extreme weather, natural disasters, or insufficient bookings.

   ii. In such cases, participants will be offered the choice of rescheduling the tour or receiving a refund.

   c) Failure to attend:

   i. If you fail to attend the tour for any reason, no refund will be provided.

3. Tour Itinerary:

   a) The itinerary provided is subject to change without prior notice due to factors such as weather conditions, traffic, or other unforeseen circumstances.

   b) We reserve the right to make alterations to the tour (including cancellation) for the safety and/or enjoyment of all participants, in our absolute discretion.
   

4. Participant Obligations and Requirements:

   a) It is the responsibility of participants to inform us of any medical conditions, allergies, or special requirements prior to the tour.

   b) Participants must follow all instructions given by the tour guide for their safety and the safety of others.

   c) Participants are expected to behave responsibly and respectfully towards other participants, the tour guide, third parties, and any locations visited during the tour.

   d) We reserve the right to refuse service or remove any participant who behaves in a disruptive or inappropriate manner, without refund.
   

5. Liability:

   a) While we take every precaution to ensure the safety of our participants, we cannot be held liable for any accidents, injuries, or losses that may occur during the tour.

   b) Participants join the tour at their own risk and are responsible for their own safety and belongings.

   c) To the extent permitted by law, our liability to you is limited, at our option, to:

   i. in the case of goods, the repair or replacement of the goods or the re-supply of equivalent goods (or paying the cost of any of these); or

   ii. in the case of any services supplied by Cronulla Guided Walks supplying the services again (or paying the cost of having the services supplied again).

   This agreement is not intended to exclude, restrict or modify any right which you have at law which may not be excluded, restricted or modified by agreement.
   

6. Photography and Recording:

   a) Participants are welcome to take photographs and videos during the tour for personal use only.

   b) Commercial use of photographs or videos taken during the tour is strictly prohibited without prior written consent.
   

7.  Indemnity:

   a) you agree to indemnify, defend and hold harmless Cronulla Guided Walks and our officers, directors, agents, contractors, licensors, subcontractors, and employees, harmless from any claim or demand, including reasonable legal costs, made by any third-party due to or arising out of your breach of these Terms and Conditions, or your violation of any law or the rights of a third-party.

   b) The indemnity referred to in this clause shall survive the termination of this agreement for all purposes.
   

8. Severability:

   a) In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
   

9. Governing Law:

   a) These terms and conditions are governed by the laws of New South Wales. Any disputes arising from or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of New South Wales.
   

10. Entire Agreement:

    a) These terms and conditions constitute the entire agreement and understanding between the parties.
    

11. Changes to Terms and Conditions:

    a) We reserve the right to update or modify these terms and conditions at any time without prior notice. The latest version of the terms and conditions will be posted on our website.
